Type 9 regulated activity and licensing
Managing a portfolio of securities or futures contracts for others is a Type 9 regulated activity under the Securities and Futures Ordinance. A licensed corporation must appoint at least two SFC-approved responsible officers for each regulated activity, with at least one an executive director, so the entry barrier rests on licensing and approval of the firm and its people rather than a single examination. Licences are granted by the type of regulated activity, and both the firm and the individual must meet the criteria on qualifications, experience and integrity.
Competence requirements for responsible officers
The SFC requires responsible officers to have appropriate academic qualifications, relevant industry experience and management experience, and to pass a local regulatory framework examination; a common guide is a relevant degree, three years of relevant industry experience within the past six years and two years of management experience. Front-line representatives have corresponding requirements, and applicants and relevant persons must also pass the 'fit and proper' criteria covering financial status, reputation and integrity. These requirements must be maintained, not met only once at approval.
Day-to-day work and pressure
A fund manager researches the macro economy, industries and individual companies, decides trades and allocation, controls concentration, liquidity and leverage risk, and reports performance to investors. Results are closely tied to the market cycle, so poor performance brings redemptions and client losses, and marketing and client communication are as important as investment judgement. The working rhythm follows market hours and quarterly performance reviews, and the pressure is felt most when markets fall and investors want explanations. Client-facing meetings and reporting obligations also make the role far more than pure stock-picking.
