Registration of local fishing vessels
The Fisheries Protection Ordinance (Cap. 171) requires all local fishing vessels to be registered with the AFCD before they may fish in Hong Kong waters; registered vessels must operate in accordance with the specified conditions including registered engine power, number of ancillary vessels and fishing methods. Non-fishing-class vessels may fish only by specified means, such as a hand line without branch lines, a hand net, without fishing gear, or while diving. Fishing with the use or aid of a vessel by other methods is an offence, liable to a maximum fine of HK$100,000 and six months' imprisonment.
Marine Department vessel licences and fishing permits
A local vessel must first obtain an Approval-in-Principle letter from the Marine Department, then complete procedures on plans, survey, Certificate of Ownership and Operating Licence before it may operate; some vessels must carry compliant third-party risks insurance. To fish in a marine park, a marine park fishing permit is required, with conditions including a valid local fishing vessel registration certificate and a Class III operating licence from the Marine Department. Night fishing with bright lights is also restricted, allowed only in designated areas and with compliant lamp shades, failing which it may be an offence.
Support, operating rules and industry reality
Fishermen work according to seasons, sea conditions and legal requirements, while maintaining engines and gear and chilling the catch to keep it fresh. The AFCD provides training, liaison services and loans to help fishermen obtain the qualifications needed to operate vessels, improve navigation knowledge and take part in leisure fisheries; the Sustainable Fisheries Development Fund also supports a shift to sustainable, high-value-added operations. Capture fisheries face resource and cost pressures, and with restrictions such as prohibited fishing areas and bright-light rules, practitioners must master both technique and regulation.
