香港嘅刑事檢控權由律政司行使：《基本法》第63條訂明律政司「主管刑事檢察工作，不受任何干涉」。律政司刑事檢控科由刑事檢控專員掌管，在原訟法庭及區域法院審理嘅案件，大部分由該科律師負責檢控；裁判法院較輕微嘅案件，多由法庭檢控主任負責。至於是否檢控、以咩控罪檢控，屬律政司嘅檢控決定，並受《檢控守則》規管。拘捕、偵查、蒐證係警方等執法機關嘅職責，檢控人員唔會自己走出街查案。《壹號皇庭》1992年首播，當時主管機關叫「律政署」，1997年後才改稱律政司，所以劇中把檢控官寫成同警方並肩偵查，屬戲劇化安排。
In Hong Kong criminal prosecutions are controlled by the Department of Justice. Article 63 of the Basic Law provides that the DoJ "shall control criminal prosecutions, free from any interference". Its Prosecutions Division, headed by the Director of Public Prosecutions, handles most cases in the Court of First Instance and the District Court; less serious magistrates' cases are often prosecuted by Court Prosecutors. Whether to prosecute, and on what charge, is a DoJ decision governed by the Prosecution Code. Investigation, arrest and evidence-gathering belong to the police and other law-enforcement agencies — prosecutors do not go out to investigate themselves. File of Justice premiered in 1992, when the department was still the Legal Department (律政署); it was renamed the Department of Justice in 1997. The show's image of prosecutors investigating alongside police is a dramatic device.
