劇中廉政公署調查員查完案就即刻拉人、上庭檢控；現實中廉署係唔係可以自己決定檢控？
In the series ICAC investigators arrest a suspect and take the case to court as soon as their investigation ends — can the ICAC decide on prosecutions itself?
事實應該係點 / What really happens
廉政公署係獨立嘅執法機構，專責調查貪污，但佢並無檢控權：調查完成後，廉署會將個案證據轉交律政司，由律政司考慮是否提出刑事檢控。按《防止賄賂條例》（第201章），該條例第II部所列主要貪污罪行——包括索取或接受利益、賄賂、代理人的貪污交易、管有來歷不明財產等——須經律政司司長同意，方能提出檢控。實際上廉署亦會在檢控前諮詢律政司嘅法律意見。所以劇中廉署拘捕、調查嘅情節大致符合現實，但「查完即刻由廉署決定檢控」就同「調查與檢控分工」嘅制度不符。
The ICAC is an independent law-enforcement agency dedicated to investigating corruption, but it has no power to prosecute: after investigation it forwards the evidence to the Department of Justice, which decides whether to bring a criminal charge. Under the Prevention of Bribery Ordinance (Cap. 201), the main corruption offences in Part II — including soliciting or accepting advantages, bribery, corrupt transactions with agents and possession of unexplained property — require the consent of the Secretary for Justice before a prosecution can be brought. In practice the ICAC also seeks the DoJ's advice before commencing a prosecution. The drama's depiction of ICAC arrests and investigations is broadly realistic, but showing the ICAC deciding to prosecute immediately after an investigation does not match the division between investigation and prosecution.
